1) Introduction

These Terms of Service (“Terms”) govern your access to and use of skycampsupply.com (the “Website”) and any related services, content, features, tools, products, and functionality we offer (collectively, the “Services”).

The Website and Services are owned and operated by PalaceofPalms LLC dba Sky Camp Supply (“Sky Camp Supply,” “Company,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services and make purchases. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

If you use the Services on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

B. Order Acceptance
Your order is an offer to purchase. We may accept, reject, or cancel an order at our discretion, including due to:

• suspected fraud or unauthorized transactions, or

• shipping restrictions or service limitations.

If we cancel an order after you have been charged, we will issue a refund to your original payment method.

A. Accepted Payment Methods
We accept the payment methods made available at checkout, which may include: Shop Pay, PayPal, Venmo, Google Pay, Apple Pay, American Express, Discover, Visa, and Mastercard, as well as buy-now-pay-later options such as Shop Pay Installments and Affirm (where available and subject to eligibility).

B. Payment Processing
Payments are processed securely through Shopify and/or Shopify’s supported payment processors. We do not store full payment card numbers.

C. Buy Now, Pay Later and Installments (Shop Pay Installments / Affirm)
If you choose a financing or installment option (including Shop Pay Installments or Affirm), your agreement is with the provider, not with Sky Camp Supply. These providers may have their own terms, approval requirements, fees, and repayment schedules, and your use of those services is subject to the provider’s terms and privacy practices. We are not responsible for decisions made by financing providers or for disputes related solely to a financing provider’s services.

D. Billing Information
You agree to provide current, complete, and accurate billing and contact information, and you authorize us (and our payment processors) to charge your selected payment method for your order, including applicable taxes, shipping fees, and any other charges disclosed at checkout.

E. Authorization Holds
Your bank or card issuer may place an authorization hold for your purchase amount. Authorization holds are controlled by your financial institution and may remain for a period even after a transaction is completed or canceled.

F. Fraud Prevention and Verification
We may use fraud-prevention tools and may request additional information to verify your identity or payment method. We may cancel or hold orders if verification cannot be completed.

G. Chargebacks and Billing Disputes
If you believe a charge is incorrect or have a billing concern, please contact us first so we can help resolve the issue. Initiating a chargeback may delay resolution and may impact your ability to place future orders.

6) Pricing, Taxes, and Promotions

A. Pricing
Prices are shown in the currency displayed at checkout and may change without notice.

B. Taxes and Fees
Sales tax (and other applicable taxes/fees) will be calculated at checkout where required by law.

C. Promotions and Discount Codes
Discounts and promotions are subject to additional terms (if stated), may be limited in time/quantity, and may be withdrawn at any time. Unless expressly stated, promotions cannot be combined.

7) Shipping and Delivery

B. Delivery Estimates
Any delivery dates or shipping estimates shown on the Website or in confirmations are estimates only and are not guaranteed. Shipments may be delayed due to factors beyond our control (carrier delays, weather, supply chain disruptions, or manufacturer lead times).

C. Split Shipments
If you purchase multiple items, they may ship separately.

D. Risk of Loss
To the extent permitted by law, risk of loss passes to you upon delivery to the carrier. If a package is lost or damaged in transit, contact us and we will help you coordinate next steps with the carrier and/or supplier as applicable.

8) Returns, Refunds, and Cancellations

Returns, exchanges, refunds, and cancellations are governed by our Return & Refund Policy. In the event of a conflict between these Terms and the Return & Refund Policy regarding returns/refunds, the Return & Refund Policy will control for those topics.

9) Product Use and Safety

Outdoor products and structures may involve inherent risks (including risks related to weather, terrain, anchoring, installation, fire, carbon monoxide, and outdoor activity). You are responsible for reading and following all manufacturer instructions, warnings, and safety guidance, and for using products properly and safely.

10) Intellectual Property

A. Ownership
All content on the Website (including text, graphics, logos, images, product curation, and software) is owned by Sky Camp Supply or its licensors and is protected by intellectual property laws.

B. Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

You represent that you own or have the necessary rights to submit User Content and that it does not violate any law or infringe any third-party rights. We may remove User Content at any time.

THE SERVICES AND ALL INFORMATION AND CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, secure, error-free, or that any results will be accurate or reliable.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKY CAMP SUPPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) OR SERVICE(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15) Indemnification

You agree to indemnify, defend, and hold harmless Sky Camp Supply and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

If a dispute cannot be resolved informally, you agree that, to the extent permitted by law:

• claims may be brought in the state or federal courts located in California, and

• you consent to personal jurisdiction in those courts.

Nothing in this section prevents either party from seeking relief in small claims court (where applicable).

20) Miscellaneous

A. Severability

C. No Waiver

D. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, carrier disruptions, supplier interruptions, or governmental actions).
